Protects vegetable gardens on residential properties in Arkansas by establishing a clear definition and framework for their cultivation. It defines a "vegetable garden" as a plot or elevated soil bed where various edible plants are grown and emphasizes the state's interest in promoting sustainable cultivation for personal consumption or noncommercial sharing. The bill allows individuals to cultivate vegetable gardens on their own property or with the owner's permission on others' property.
Importantly, the bill prohibits counties, municipalities, or other political subdivisions from regulating vegetable gardens on residential properties, rendering any local ordinances or regulations that do so void and unenforceable. However, it does allow for the adoption of general regulations that do not specifically target vegetable gardens, such as those related to water use during droughts or the control of invasive species. This legislation seeks to encourage gardening while ensuring that local governments cannot impose restrictions that would hinder this practice.
